SC dismisses PTI chief's plea against Toshakhana trial

Islamabad (Web Desk): The Supreme Court (SC) on Friday said that trial court cannot decide the Toshakhana case against former prime minister and Pakistan Tehreek-e-Insaf (PTI) chief till Islamabad High Court (IHC) announces a final verdict into a set of petitions filed by PTI chief.

A three-member SC bench headed by Justice Yahya Afridi, and comprising Justice Musarat Hilali and Justice Hasan Azhar Rizvi announced the order.

The Supreme Court of Pakistan concluded all appeals related to the Toshakhana case involving former Prime Minister Imran Khan.

During the hearing, PTI chief's lawyer Khawaja Haris told the court that the decision on plea to transfer the case has been reserved by IHC.

The court said that the Election Commission of Pakistan (ECP) has also admitted that the trial court cannot make a final decision until an IHC decision.

Following Imran Khan's withdrawal of his plea, the Supreme Court concluded all petitions related to the Toshakhana case.

In its remarks, the top court said that both the high court and the trial court should uphold the spirit of the law throughout the proceedings.

The court acknowledged that the request to transfer the case to another court is still pending before the high court.

Earlier, the SC had constituted a fresh three-member bench to hear the Toshakhana case against the PTI chief. as Justice Hasan Azhar Rizvi has replaced Justice Mazahir Ali Naqvi in the bench.

On Thursday, the IHC had reserved its verdict on a set of petitions filed by the former premier against the Toshakhana trial, and is expected to issue the said verdict today.

The IHC will also issue the reserved verdict on PTI chief's appeal against the trial court’s order to refuse his right to produce witnesses in the case.
